WatER2017 Application
The owner and operator of the WatER2017 Application (hereinafter the “Application”, the “App”), and the holder of all related rights is SEMMELWEIS Egészségügyi Szolgáltató és Tanácsadó Korlátolt Felelősségű Társaság (legal seat: 1085 Budapest, Üllői út 26., Hungary; company registry number: 01-09-879749; tax ID: 13916974-2-42; statistical number: 13916974-8622-113-01, hereinafter Provider).
The Application is a free-of-charge mobile application software owned and provided by Provider. By downloading and using the App, Users get support during the FINA 2017 WCH, since through the App they can quickly receive information on the location of the nearest Medical Service stations and on how to get there.
Amendments, software upgrades
Provider retains the right to unilaterally amend these Terms of Use, with prior notification to Users. Upon first use of the Application following any amendment having become effective, by clicking the “Accept” button underneath the Amended Terms of Use, User accepts the Amended Terms of Use. If User fails to accept the Amended Terms of Use, User is not allowed to log in to the App.
Provider is entitled to amend, update, or withdraw the Contents, in full or in part, any time, without prior notification.
The purpose of the software upgrades is to extend, fix, and improve the Application, and to inform Users about the availability of new services. By using the Application, User agrees to receive such upgrades, and acknowledges that the implementation of the changes might impact the availability of the App.
Intellectual property rights
The overall image of the App, the compilation, arrangement and editing of the content and the content itself (hereinafter: the Contents), due to their unique and original nature, are copyrighted. The copyright holder is Provider, and as such, Provider is solely entitled to authorise any third party use of the copyrighted material.
It is prohibited to copy, duplicate, republish or distribute the Contents in any format, in full or in part, without Provider’s prior written consent, except for cases when Provider has made a clear and explicit statement to authorise any such use. Further, it is prohibited to create or adapt any material or work, by the use of, or based on the Contents, including in particular making, or providing unauthorised access to, or distributing, or selling any font, icon, button, link, wallpaper, screensaver, text, picture, graphic design, logo, postcard, photo, audio or video recording.
Provider hereby authorises User to download the App to User’s mobile phone free of charge, and thus to receive a one-time right to use the App, which right however excludes the right of duplication, distribution or editing. Any type of commercial use is subject to Provider’s prior written consent. User shall respect all copyrights, and other rights related to the Contents.
Any copyright violation may result in civil (Chapter XIII of Act LXXVI of 1999 on Copyright) or criminal (Chapter XXXVII of the Criminal Code) action.
How to use the App
Users can download the Application free of charge from Google Play or the iOS App Store. The service is provided by Provider, in relation to which User undertakes to promptly notify Provider of any potential unauthorised use of User’s User ID. The use of the App may generate data usage!
Exclusion of liability
Provider excludes any liability for the reliability, operability or accessibility of the Application, or for any of the Contents therein proving to be incorrect or not precise, or for any potential health disadvantage caused to Users. Users use the App solely at their own risk and liability, and Provider is not liable for any damage caused by any improper or erroneous use of the Application, or due to the Application being unavailable, or for any material, non-material damage, consequential damage, or any profit loss arising due to the use of the Application. Provider has no liability whatsoever for the activities carried out by the healthcare providers listed in the App.
Provider uses links to third party websites in the Application. However, Provider has no liability whatsoever for contents and websites provided by third parties, and is not liable for any damage caused by the use of such websites. Such websites and their use are subject to the terms of use defined by the third parties.
User hereby acknowledges that Provider is not liable for any error occurring to User’s mobile phone, or for any damage or data loss caused by any virus, or for any unauthorised access to User’s mobile phone, or for any other damage caused by third parties, or occurring due to a Force Majeure event.
Intended use
User is not entitled to use the App for any purpose other than the above. Unlawful or unauthorised activities include, but are not limited to the following:
